Juwayriyah and Her Mukātabah
There is what ʿĀʾishah (may Allah be pleased with her) said about an event that happened during the ghazwah of Banū al-Muṣṭaliq. This is by Ibn Isḥāq, but it's also narrated by al-Ḥākim, and it is a jayyid sanad, a good chain of narrators; it is also in Sunan Abī Dāwūd (3931). ʿĀʾishah (may Allah be pleased with her) said, "When the Messenger of Allah distributed the captives taken from Banū al-Muṣṭaliq, Juwayriyah, daughter of al-Ḥārith, was awarded to Thābit ibn Qays ibn Shammās." There was one woman who was taken captive, and she is the daughter of the head of the tribe. Her name is Juwayriyah, and she wrote a mukātabah: ʿĀʾishah said she made a mukātabah with Thābit ibn Qays. Now, mukātabah is a contract between the master and the slave which would allow the slave to be emancipated, to be freed, by paying a certain amount of money; it is the contract the Qur'an speaks of in Sūrat al-Nūr (24:33). So Islam doesn't make slavery a perpetual thing on a person; it's not permanent. A person who desires to be free does have that right and can be free.
